BETA ACCESS AGREEMENT
Digital MARB Terms & Conditions
Beta-stage contractual draft. These terms require review by qualified counsel before broad commercial deployment. They are not represented as attorney-reviewed.
By affirmatively accepting these Terms and continuing through secure sign-in, you agree to the following conditions governing your limited access to the Digital MARB beta.
1. Beta status and authorized access
Digital MARB is an experimental, prerelease system under active development and testing. Access is limited, revocable, non-transferable, and solely for authorized beta testers. Do not share credentials or permit another person to use restricted beta functionality. DATUM Labs may suspend or terminate access when reasonably necessary for security, misuse, a violation of these Terms, or the conclusion of the beta program.
2. Information sources
Digital MARB uses information obtained from publicly available sources, properly licensed commercial sources, authorized user submissions, and other sources DATUM Labs is legally authorized to access and use. DATUM Labs does not represent that Digital MARB provides access to non-public government databases or privileged government information.
Illustrative, non-exhaustive source categories include publicly released federal, state, and local government information; NOAA and other public environmental or maritime information; publicly available maritime, aviation, and geographic information; properly licensed third-party data and communications services; and authorized user-submitted or beta-test information. This description does not disclose or define DATUM Labs’ proprietary sourcing methods.
3. Experimental information
Information may be delayed, incomplete, inaccurate, duplicated, incorrectly classified, or unavailable. Automated transcription, extraction, classification, geolocation, and alert-generation processes may produce errors. Independently verify information when appropriate and report suspected errors through the established beta-feedback process. Digital MARB is not an official government system.
4. No government affiliation or endorsement
DATUM Labs and Digital MARB are independent and are not affiliated with, endorsed by, sponsored by, or acting on behalf of the United States Coast Guard, Department of Homeland Security, NOAA, or any other government entity unless expressly stated otherwise in writing. Attribution to a public source does not imply that source’s endorsement.

6. Confidentiality
You must protect non-public DATUM Labs information encountered through beta access, including non-public features, unreleased functionality, internal documentation, testing materials, screenshots or recordings of restricted beta functionality, non-public performance information, proprietary workflows, product roadmaps, unreleased software behavior, and technical or business information identified as confidential. Use such information only to evaluate the beta, and do not disclose it without written authorization.
These obligations do not apply to information that is already lawfully public, is independently developed without use of DATUM Labs confidential information, or is lawfully obtained from another source without a confidentiality obligation. Publicly available government information does not become DATUM Labs confidential information merely because Digital MARB displays it.
7. Limited competitive-use restriction
You may not use confidential beta access to reverse engineer proprietary functionality, systematically reproduce proprietary Digital MARB workflows, copy legally protected interface elements or non-public product designs, extract confidential technical or business information, or build a directly competing product using DATUM Labs confidential information obtained through beta access. This restriction does not prohibit lawful employment, maritime activity, independent software development, or legitimate competition based on independently developed or lawfully obtained information. Enforceability may vary by jurisdiction and requires legal review.
8. Intellectual property
Beta access does not transfer ownership of Digital MARB or DATUM Labs intellectual property, including applicable rights in software, interface designs, branding, documentation, proprietary workflows, protectable databases or compilations, analytical methodologies, and other proprietary materials. DATUM Labs does not claim ownership of underlying public-domain or third-party information merely because the service ingests, organizes, analyzes, or displays it. Third-party rights remain with their respective owners.
9. Assumption of risk; limitation; release
You understand the experimental nature of prerelease software and assume the risks inherent in beta evaluation, including incorrect, incomplete, or delayed information; missed communications or alerts; incorrect transcription or classification; service interruptions; software errors; third-party data errors; and decisions made using displayed information. To the maximum extent permitted by applicable law, you release and agree to hold harmless DATUM Labs and its personnel from claims arising from your authorized beta use or reliance on the beta, except to the extent liability cannot lawfully be excluded or limited. Nothing in these Terms excludes or limits liability that applicable law does not permit to be excluded or limited.
10. No warranty
To the maximum extent permitted by applicable law, Digital MARB is provided during beta testing on an “as is” and “as available” basis, without warranties of accuracy, completeness, availability, reliability, fitness for a particular purpose, continuous operation, or successful alert delivery.
11. Privacy and beta data notice
Information generated during beta testing may be collected for legitimate security, troubleshooting, performance evaluation, product improvement, beta-test analysis, and audit and acceptance-record purposes. These Terms do not make unverified promises about retention, deletion, sharing, encryption, or other privacy practices. Additional privacy representations should be made only after verification against the implemented system.
12. Acceptance and revisions
Your acceptance is recorded with your authenticated account identifier, acceptance date and time, this Terms version, and its effective date. Materially revised terms will use a new version and may require fresh affirmative acceptance before access. Acceptance of Version 1.0 is not acceptance of materially different future terms.
